Translation of Cross-Border Bankruptcy Documents: Scope and Steps

This guide addresses document translation where a foreign bankruptcy proceeding and a Saudi proceeding are concurrent, where a foreign representative or court seeks assistance from a Saudi court, where a Saudi representative seeks assistance from a foreign authority, or where a foreign creditor or interested person participates in a Saudi proceeding. Translation is most directly relevant to documents accompanying an application to recognize a foreign bankruptcy proceeding, including the decision opening the proceeding and appointing the foreign representative, a certificate confirming that the proceeding and appointment remain in force, and a statement of other foreign proceedings concerning the debtor known to the representative. The court may request that the foreign representative translate submitted documents into Arabic for consideration of the application, but this does not establish that every foreign document must be translated before filing. The court may also accept information and documents even if they are uncertified, and may accept another document showing that the proceeding is in force and that the representative was appointed when a specified document cannot be obtained; acceptance or rejection remains for the court to decide. Depending on the application type, a file may include financial statements and financial-position information for 24 months, financial statements for the last two years, debt and security schedules, asset schedules, litigation, judgments, and enforcement instruments. Translation does not replace required documents or by itself establish the requirements for recognition or jurisdiction, so the current application, filing channel, and court requirements should be checked before filing.

  • Decision opening the foreign bankruptcy proceeding
  • Decision or certificate appointing the foreign representative
  • Foreign court certificate confirming that the proceeding and appointment remain in force
  • Statement of other foreign proceedings concerning the debtor
  • Written judicial-assistance request and attachments
  • Decision or judgment opening a Saudi proceeding, if applicable
  • Debtor’s constitutive documents, bylaws, and amendments
  • Financial statements and related financial information, including information for the last two years or a 24-month period depending on the application type
  • Debt schedule, supporting documents, and security details
  • Litigation, judgments, and enforcement instruments concerning the debtor

Confirm that the matter concerns recognition of a foreign bankruptcy proceeding, judicial assistance, or participation by a foreign creditor or interested person—within the scope of this context.

Identify the court and application; the court considers applications for recognition of foreign bankruptcy proceedings and requests for judicial assistance.

Prepare the opening and appointment decision, the certificate confirming that the proceeding and appointment continue, and the statement of other foreign proceedings. If a specified document cannot be obtained, another document showing that the proceeding and appointment remain in force may be submitted, subject to the court’s acceptance or rejection.

A judicial-assistance request must be written and include the parties’ names, the addresses of persons to be notified if any, and the nature and reasons for the assistance.

If the court requests it to consider the recognition application, translate the submitted documents into Arabic. A universal requirement to translate every foreign file before filing is not established.

When using the Ministry of Justice service, sign in to Najiz, select Judiciary and the bankruptcy application service, complete the data, attach supporting documents according to the application type, then submit and track the application.

Document type Common use Note

What is cross-border bankruptcy?

It is a context involving a foreign and Saudi bankruptcy proceeding, a request for assistance between a Saudi court and a foreign court or representative, or participation by a foreign creditor or interested person, within the cases covered by the Rules.

What are the core documents for recognition of a foreign proceeding?

The opening decision and appointment of the foreign representative, a certificate confirming that the proceeding and appointment remain in force, and a statement identifying other foreign proceedings known to the representative.

Must every document be translated into Arabic before filing?

That is not established as a universal rule. The court may request Arabic translation of documents for considering the application.

May the court accept uncertified documents?

Yes. The court may accept information and documents even if they are uncertified, while acceptance remains for the court to decide.

What if one of the specified documents cannot be obtained?

Another document showing that the foreign proceeding is in force and that the foreign representative was appointed may be submitted; the court may accept or reject it.

Who requests the Arabic translation?

The Rules authorize the court to request it from the foreign representative. The Rules do not establish a translator roster or uniform certification form.

Is translation alone enough for recognition?

No. Translation does not replace the required documents and does not by itself establish the requirements for recognition or jurisdiction.

Which languages must the translation cover?

The Saudi text addresses a request to translate documents into Arabic. It does not set a universal rule for additional languages or foreign-country requirements.

Is a sworn translation mandatory?

That is not established by the Rules covered here. Any specific request from the court or foreign destination authority should be checked rather than assumed.

Which financial records may appear in the file?

Depending on the application type, they may include financial statements, financial-position information, debt schedules, security details, and asset schedules.

Can the translation include litigation and judgments concerning the debtor?

Litigation, proceedings, judgments, and enforcement instruments may form part of the information and documents required for some bankruptcy applications.

How is a bankruptcy application filed electronically?

The Ministry of Justice service describes signing in to Najiz, selecting Judiciary and the bankruptcy application service, completing the data, attaching documents, then submitting and tracking the application.

Is a translation tariff published for these files?

This guide does not identify a translation tariff for these files. Any statement about a filing-service fee does not establish the charge of an independent translator.

Does a translation guarantee acceptance in another country?

No. The foreign state’s rules and the requirements of its court or authority may differ, and this guide does not guarantee acceptance outside Saudi Arabia.

Is there a uniform translation validity period?

This guide does not establish a uniform period. The copy should be tied to the document date and proceeding status, and any specific request should be verified.

This guide is for general information and is not legal or consular advice. Always verify current requirements with the receiving authority.
